All membership cards, books and directories remain the property of Simard Ltd at all times.
Gourmet Society promotions and offers cannot be used in conjunction with any other offers.
All information provided is correct at the time of publication. However, no liability is offered for errors contained herein, or the actions of 3rd parties.
All queries must be put in writing and marked for the attention of The Operations Manager and sent to our Manchester office.
Gourmet Society membership agreement
Your contract is made up of two parts - your welcome letter/email and these Gourmet Society Terms and Conditions (“your agreement”). Please keep your welcome letter/email/online application form and these Gourmet Society Terms and Conditions together and in a safe place for future reference.
Gourmet Society membership is only available to residents living within the UK and Republic of Ireland. Membership is automatically cancelled if you move outside the UK or Republic of Ireland. You cannot transfer your agreement to someone else without our written permission.
Please read this document carefully and keep it in a safe place with your welcome letter/email/online application form as it describes the services provided and what you need to do to obtain the full benefits of membership.
Definitions of words used in your agreement
fees The amount payable by you for your membership as set out in your welcome letter/email/online application form.
member, you, your You being the person who pays for this agreement.
membership period The period in which you are entitled to the membership and services. This is shown on your welcome letter/email/online application form. It also includes any further period, which you may pay for or agree to pay for and for which Gourmet Society agree to accept your application.
Gourmet Society is a trading name and trademark of Simard Limited,

start date The date confirmed to you that your membership starts as shown in your welcome
letter/email/online application form.
trial period If you are entitled to a trial period, this will be confirmed in your welcome letter/email/online application form as your trial period.
UK The United Kingdom, Channel Islands and the Isle of Man.
website The Gourmet Society website at www.gourmetsociety.co.uk.
welcome letter/email/online application form The welcome letter/email/online application form containing important details including details of your fees and of the card, bank or other account which will be debited and forms a part of your agreement.
membership card, a card that details your membership, including an expiry date and membership number
service, the Gourmet Society will provide you the opportunity to utilise discounts in a selection of restaurants

Choice of Law
Unless Gourmet Society agree otherwise:
A. the language of your agreement and all communications relating to it will be English; and
B. all aspects of your agreement, including negotiation and performance, is subject to English law and the decisions of
English courts unless you choose the jurisdiction of your domicile if you are domiciled in Scotland.
How to make a complaint regarding the services provided by Gourmet Society
If you have cause for dissatisfaction and wish to complain about the service elements of this product or about the way in which your agreement was sold please contact Gourmet Society
on 0845 257 4477 or write to: Customer Services Manager, Gourmet Society, Redbrick Mill, Mottram Street, Stockport, Cheshire, SK1 3PA quoting your membership number. Gourmet Society aims to promptly solve most of our customersÂ’ complaints at the initial point of contact.
Gourmet Society staff are fully trained to deal with your complaint quickly and efficiently. However should you not be satisfied with the response you have received, your complaint will be responded to by the Customer Relations Team who will aims to resolve your complaint, if this is possible, by the end of the next working day following receipt of your complaint. If Gourmet Society cannot resolve your complaint within this time they will inform you within 5 working days, and do their best to resolve the problem within 4 weeks. If Gourmet Society cannot respond within these timescales they will inform you again within 4 weeks to provide you with a final response or to let you know when they will contact you again, which will be within 8 weeks from when you first contacted Gourmet Society about your complaint.
Data Protection Act
The details you supply will be stored securely and used by Gourmet Society to administer your Gourmet Society membership. Information may be disclosed to regulatory bodies and/or your bank or card issuer and/or our or Gourmet Society subcontractors for the purposes of providing the services. These details will not be kept for longer than necessary. You are entitled to a copy of all of the information held about you for which Gourmet Society may charge you £10. Your bank/card issuer will pass your name, address, date of birth and card details to Gourmet Society for the purpose of providing the product and for future renewals for the purpose of billing your account with the fees. By entering into your agreement, you give your consent to the transfer of data outside of the EEA including to the USA for the purposes of data processing relating to the provision of services. They will at all times be held securely and handled with the utmost care in accordance with all principles of English law. Unless you have requested otherwise, your details may also be used by Gourmet Society or passed to carefully selected third parties so as to send you information about products and special offers that may be of interest to you. Your data may also be disclosed to third parties where required by law or in the event that Gourmet Society merges with or is bought by another company, or otherwise undergoes a corporate restructuring. Notice to Customers – call recording
You are advised that any telephone calls made to the Gourmet Society servicing units may be recorded. These recordings may be used to monitor the accuracy of information exchanged between customers and the staff. They may also be used to allow for additional training to be provided or to prove that the procedures comply with legal requirements. The staff are aware that conversations are monitored and recorded.
Gourmet Society Limitation of Liability
This section (and any other section excluding or restricting our liability) applies to our directors, officers, employees, subcontractors, agents and affiliated companies as well as to us. Nothing in your agreement in any way limits or excludes our liability for negligence causing death or personal injury or for fraudulent misrepresentation or for anything which may not legally be excluded or limited. Without prejudice to the rest of your agreement, our liability of any kind in respect of any services or otherwise shall be limited to the amount equal to fees payable by you in any 12
month period under your agreement. In no event will we be liable for any:
1. economic losses (including, without limit, loss of revenues, profits, contracts, business or anticipated savings)
2. loss of goodwill or reputation
3. losses that you incur that were not reasonably foreseeable to you and us when your agreement was entered into, or
4. damage to or loss of data, to the extent that this was not in the contemplation of Gourmet Society
and you at the commencement of the membership period and is not attributable to our negligence or breach of your agreement.
Gourmet Society will not pay for losses arising from our inability to provide the services in the event of war, terrorism, invasion, an act of foreign enemy, hostilities (whether war be declared or not), riot, strike, civil commotion, civil war, revolution, insurrection or military or usurped power or for any reason that is beyond our reasonable control.
General rights
Your agreement constitutes the entire agreement between you and Gourmet Society . Any failure by Gourmet Society to exercise or enforce any right or provision of your agreement shall not constitute a waiver of such right or provision. If any provision of your agreement is found by a competent jurisdiction to be invalid, then the remaining provisions shall remain in full force and effect.
Gourmet Society Dining Service provides annual membership to the Gourmet Society offering access to varying special offers at restaurants within the United Kingdom.
You agree to pay the fees of Gourmet Society membership
1. The service can be used once your Gourmet Society membership application has been processed and a membership card has been issued to you.
2. Gourmet Society promotions and offers cannot be used in conjunction with any other offers.
3. Please check availability of the Gourmet Society offer on Bank Holidays, ValentineÂ’s Day, New YearÂ’s Eve, the Christmas period and any other special days as these are often excluded.
4. All information provided is correct at the time of publication. However, no liability is offered for errors contained on the Gourmet Society website, or the actions of third parties.
5. Your Gourmet Society membership will be renewed automatically and your credit/debit card, or other payment method, will be charged for the next year of membership. You will be charged the standard membership rate at the time of renewal. A new membership card will be processed and issued to you. You may cancel at any point within 30 days of the new card being issued.
ACCESSING RESTAURANT DISCOUNTS
6. You can search for restaurants and view the exclusive Gourmet Society promotional offers online via the dedicated Gourmet Society website at www.gourmetsociety.co.uk.
7. The discount provided by the restaurants varies, with the majority offering either 2 meals for the price of 1 or a 25% discount off the total bill. Please check the details for the individual restaurant for specific details of the offer, including how many meals or diners the discount applies to and how many membership cards can be presented per dining party.
8. Some restaurants require you to book in advance by telephone using the telephone number displayed on their page of the website. When you telephone the restaurant you must state that you are a Gourmet Society member.
9. You will only have to pay the relevant restaurant after you have eaten.
10. When you arrive at the restaurant you can order whatever food you want from the normal à la carte menu.
11. Present your membership card to the waiter at the end of your meal and your bill will be presented to you, minus your Gourmet Society discount.
12. Your membership card must be presented to receive the discount.
13. If appropriate the waiter will restrict the number of times you can use your card by writing the restaurantÂ’s number in the space allocated on the reverse of your card.
Charging of fees
1. We will charge you the membership fees annually until cancelled for Gourmet Society services
2. We will issue you with a new membership card each year. We will charge you the fee each year.
3. You may cancel at any point within 21 days of us issuing you with your first membership card.
4. We will not refund you for fees that have been taken if you have not returned your membership card, and/or we have not received it at our trading offices, before we have taken the fees.
5. If you have joined using a trial period the details of how your trial works and your right to cancel will be detailed in the welcome letter that was sent over to you with your welcome pack. If you have misplaced your welcome letter or are unclear of your trial's terms, conditions and cancellation instructions , please call us on 0845 257 4477 for this information. We regret that we are unable to offer any refunds of membership fees paid after your trial period has ended. Our standard refund policy does not apply to memberships that were initially trial memberships.
Alterations to your agreement
We will inform you of any alterations to this agreement in writing to the email address you have provided. If we make any significant alterations you may cancel your agreement within 14 days of us informing you of the alteration.
